Terms of Service

1. Agreement to these Terms

These Terms of Service ("Terms") form a binding agreement between you and SSSAI LLC ("SSSAI", "we", "us", or "our") and govern your access to and use of our websites, AI-powered tools, applications, and API services (collectively, the "Services"). By accessing or using the Services, you agree to these Terms and to our Privacy Policy. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization, and "you" refers to that organization.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Services. You agree to use the Services only in compliance with these Terms and all applicable laws.

3. Accounts

To access certain features you must create an account. You agree to provide accurate information, keep it current, and keep your credentials and API keys confidential. You are responsible for all activity that occurs under your account, and you must notify us promptly of any unauthorized use.

4. Subscriptions, fees, and billing

Some Services are offered on free and paid plans. Paid subscriptions and API usage are billed according to the pricing in effect at the time of purchase. Unless otherwise stated:

  • subscription fees are billed in advance on a recurring basis, and API usage is billed based on consumption;
  • fees are exclusive of taxes, which you are responsible for;
  • plans renew automatically until cancelled, and you may cancel at any time with effect at the end of the current billing period;
  • except where required by law, payments are non-refundable; and
  • we may change our prices or plans on prospective notice.

5. Acceptable use

You agree not to, and not to permit others to:

  • use the Services in violation of any law or the rights of others;
  • upload or generate content that is unlawful, infringing, defamatory, or harmful, or that facilitates such content;
  • attempt to gain unauthorized access to, disrupt, or interfere with the Services or related systems;
  • reverse engineer, decompile, or attempt to extract the source code or underlying models, except as permitted by law;
  • circumvent usage limits, rate limits, or security measures;
  • use the Services to develop a competing model or product, or resell the Services without our permission; or
  • access the Services by automated means other than through our documented APIs.

6. Customer Content

You retain ownership of the content and data you submit to the Services and the outputs generated for you ("Customer Content"). You grant SSSAI a limited, worldwide, non-exclusive license to host, process, transmit, and display Customer Content solely to provide and improve the Services. You represent that you have the rights necessary to your Customer Content and that it does not violate these Terms or any law.

7. AI-generated output

Our Services use artificial intelligence to generate outputs. Given the nature of machine learning, outputs may be inaccurate, incomplete, or offensive, and may not be unique to you. Outputs are provided for your evaluation, and you are responsible for reviewing and verifying them before relying on or publishing them. The Services do not provide legal, financial, medical, or other professional advice.

8. Intellectual property

The Services, including all associated software, models, content, and trademarks, are owned by SSSAI or its licensors and are protected by intellectual property laws. Except for the rights expressly granted to you, we reserve all rights. If you provide feedback or suggestions, you grant us a perpetual, royalty-free license to use them without restriction.

9. Third-party services

The Services may integrate with or link to third-party products and services that are governed by their own terms and privacy policies. We are not responsible for third-party services, and your use of them is at your own risk.

10. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any output will be accurate or reliable.

11. Limitation of liability

To the maximum extent permitted by law, SSSAI and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill. Our total liability for any claim arising out of or relating to the Services will not exceed the amount you paid us for the Services in the twelve months preceding the event giving rise to the claim, or one hundred U.S. dollars (USD 100) if you have not paid us.

12. Indemnification

You agree to indemnify and hold harmless SSSAI and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your Customer Content, your use of the Services, or your violation of these Terms or applicable law.

13. Term and termination

These Terms remain in effect while you use the Services. We may suspend or terminate your access at any time if you violate these Terms or to protect the Services or other users. You may stop using the Services at any time. Provisions that by their nature should survive termination — including ownership, disclaimers, limitation of liability, and indemnification — will survive.

14. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-laws rules. You agree that any dispute will be subject to the exclusive jurisdiction of the state and federal courts located in Wyoming, unless applicable law requires otherwise. Before filing a claim, you agree to first try to resolve the dispute informally by contacting us.

15. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Services after the changes take effect constitutes acceptance of the revised Terms.

16. Miscellaneous

These Terms, together with our Privacy Policy, are the entire agreement between you and SSSAI regarding the Services. If any provision is found unenforceable, the remaining provisions will remain in effect. We may assign these Terms in connection with a merger, acquisition, or sale of assets. Our failure to enforce a provision is not a waiver, and we are not liable for delays or failures caused by events beyond our reasonable control.
